Circles of Care

In July 26, 2012 Gail was forcibly committed to Circles of Care, a psychiatric hospital in her town of Melbourne.

The Baker Act

In Florida, the Baker Act was designed to serve as an emergency means for keeping the severely mentally ill from harming themselves in cases where a person has made threats of suicide or has expressed evidence of becoming a danger to themselves. However, in order for a person to be Baker Acted, a witness must provide sworn testimony or evidence relating to a specific incident in which the person being Baker Acted tried to harm themselves.

Conspiracy to Commit

Sandra Metcalf, Gail's sister, was growing increasingly embarassed by Gail's online antics. Under the encouragement of David Schuler, who himself had tried and failed to harass Gail into not mentioning him online, Sandra decided to go forward with a plan that would get Gail to shut up for good and punish her for humiliating them. Since she knew that Gail has never been a harm to herself or others, Sandra knew that she had to lie in order to get her sister locked up.

Sandra wrote a letter to a judge in Gail's hometown stating that she had personally witnessed the men telling Gail to go run out into the middle of the street. She then gave this letter to Misao and told Misao to sign it as her own statement. She did not explain to Misao what was about to happen (that Gail would be locked up) or what the letter said (Misao cannot read or write English), but she expressly forbid her from telling Gail it was her sister that wrote the letter. Misao agreed to take the blame should Gail become angry for getting psychiatric treatment, and not mention Sandra's involvement.

Not only was Gail forced into the hospital against her will, she missed the classes required for her unemployment benefits, and was unable to look for work or contact unemployment during her stay. Her battle with David, who had months ago barraged WalMart with threatening calls and lawyer letters, had already cost Gail her employment, and the forced imprisonment by Sandra nearly cost her the last fringes of her financial support.

Finding Gail

The men began to grow worried when Gail, in an uncharacteristic bout of silence, hadn't sent Brent any e-mails for several days.

One week later, Gail sent Brent the following letter:

[post letter]

In summary, Gail was arrested, taken to the hospital for three days, and put on the new medication Seroquel. During this time, she believed she was talking to Gerard Butler brain to brain who advised her to stay calm and do as the doctors told her. Gail agreed to stay at the hospital for four more days (for a total stay of one week) and felt that the medication was helping her feel better.

The Investigation

Upon reading the letter sent to the judge regarding Gail, the men grew very angry. An agent of Terrance Jenkins called up Gail's Mom to figure out what happened.

[post mother call]

After a cautious discussion, the men decided to tell Gail what they knew about Sandra and her mother, and encouraged Gail to take legal action. However, when Gail went to the judge to explain that she was never told to run into the street, and that she had taped evidence of Misao admitting that Sandra told her to lie, it was too late. Gail was upset and furious, but continued to honor her sister by not using her name in any videos or on her website. To this day, she is still afraid that they will lie again at any time to have her forced back into a hospital.
